Terms of Use & Privacy Agreement

Introduction:

Welcome to Unique Bike. This agreement outlines the terms and conditions governing your use of this e-commerce platform and all legal implications resulting from your use of the store’s online services. By accessing or using the store, whether as a consumer of a service or a product, you acknowledge and accept, with full legal capacity as recognized by Sharia and Saudi law, all articles and provisions of this agreement. This agreement is effective and enforceable upon your consent and registration, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Definitions:

1. (The Store): Refers to Unique Bike and all forms of its electronic platforms.
2. (The Consumer): Any person engaging in e-commerce to obtain motorcycle spare parts or accessories available on the platform.
3. (The Agreement): Refers to these Terms and Conditions which govern the relationship between the parties involved.

Article 2 - Legal Capacity of the Consumer:

1. The consumer acknowledges that they possess the legal capacity required by Sharia and Saudi law to engage with the store, or that they are at least eighteen (18) years of age.
2. The consumer agrees that in the event of a violation of this article, they shall bear all resulting legal consequences toward third parties.

Article 3 - Nature of Obligation:

1. The obligation of Unique Bike toward consumers is to provide products (spare parts and accessories) according to the specifications displayed in the store.
2. The consumer acknowledges that the installation of spare parts requires specialized technicians. The store is not obligated to provide installation services or technical consultations unless explicitly stated as an independent service.

Article 4 - Usage Controls:

1. The consumer commits to using the electronic platform in compliance with the regulations in force in the Kingdom of Saudi Arabia.
2. The consumer commits not to use the products purchased from the store in a manner that violates traffic laws or prevailing security regulations.

Article 5 - Accounts and Registration Obligations:

1. The consumer is responsible for maintaining the confidentiality of their account information and password and is fully liable for all activities occurring under their account.
2. The store commits to handling the consumer’s personal information and contact details with strict confidentiality in accordance with the Privacy Policy.

Article 6 - Fees and Amendments:

1. The store reserves the right to modify product prices or shipping fees in line with economic changes or taxes (such as Value Added Tax - VAT).
2. The store management reserves the right to amend the terms of this agreement, and previous versions shall remain valid unless the consumer is notified otherwise.

Article 7 - Payment and Settlement Services:

1. The store provides multiple approved electronic payment options within the Kingdom of Saudi Arabia.
2. The store commits to providing the consumer with an official tax invoice detailing the purchase value, taxes, and applicable fees.

Article 8 - Intellectual Property:

All intellectual property rights related to Unique Bike, including logos, images, and digital content, are the sole property of the store. They may not be used or quoted without prior written permission.

Article 9 - Liability of the Store:

1. The store commits that all products are sound, legitimate, and authorized under the laws of the Kingdom of Saudi Arabia.
2. The store shall not be liable for any claims arising from consumer negligence or errors caused by third parties (such as shipping companies).

Article 10 - Disclaimer: Mechanical Failure and Incorrect Selection:

1. Responsibility of Selection: The consumer acknowledges that they are solely responsible for selecting the correct spare part suitable for the make, model, and manufacturing year of their motorcycle. The store is not responsible for any incompatibility if the consumer ordered the part incorrectly.
2. Technical Installation: Unique Bike completely disclaims any liability for mechanical failures, accidents, or direct/indirect damages to the motorcycle or the user resulting from incorrect installation or installation performed by an unqualified technician.
3. Mechanical Performance: The store does not guarantee the performance of the motorcycle after installation if there were pre-existing defects in other parts of the vehicle that led to the failure of the newly purchased part.

Article 11 - Governing Law:

This agreement is governed, formulated, and interpreted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is subject to the exclusive jurisdiction of the competent authorities therein.
